These Terms and Conditions ("Terms") govern the use of the FASTag onboarding and issuance journey ("Services") made available through the DelFin by Delhivery mobile application ("Application"). Please read these Terms carefully before using the Services.

1. Acceptance of Terms

By accessing the FASTag section of the Application, initiating the onboarding journey, clicking "I Agree", "Proceed", "Submit" or any similar button, or otherwise using the Services, you ("User", "you") confirm that you have read, understood and agree to be bound by these Terms, our Privacy Policy, and any other applicable terms referenced herein.

If you do not agree to these Terms, you must not proceed with the Services.

These Terms constitute a legally binding electronic contract between you and Delhivery Fintech Distribution Private Limited ("Platform", "we", "us", "our") under the Information Technology Act, 2000 and the rules made thereunder.

2. Nature of Services

The Platform is solely a technology facilitator enabling Users to apply for a FASTag through the Application. The Platform:

• is not the issuer of the FASTag;
• does not independently approve, verify, sanction or reject any FASTag application;
• does not conduct KYC verification on its own account or for its own purposes;
• merely collects information from the User through the Application and transmits such information securely to the Issuing Bank through API integrations.

All decisions relating to KYC sufficiency, vehicle eligibility, hotlist/blacklist status, and approval or rejection of a FASTag application rest solely with the Issuing Bank, NPCI, IHMCL, or the relevant Government Authority. Submission of an application does not guarantee issuance of a FASTag.

3. Eligibility

To use the Services, you must:

• be at least 18 years of age;
• be the registered owner of the Vehicle, or be duly authorised by the registered owner;
• hold a valid Aadhaar number and PAN;
• hold a valid, subsisting RC for the Vehicle;
• have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.

4. User Registration & Authentication

You shall register/log in to the Application using your registered mobile number and such authentication mechanism as the Application may prescribe (OTP, PIN, biometric login, etc.). You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted through your account.

5. Aadhaar Authentication

Aadhaar-based authentication shall be carried out strictly in accordance with the Aadhaar Act, 2016, the Aadhaar (Authentication and Offline Verification) Regulations, 2021, and applicable UIDAI circulars. Authentication is performed only with your free, informed and specific consent. You may withdraw consent at any point prior to submission of the authentication request.

6. Collection of Personal Data

In the course of the Services, the Platform collects: identity information (Aadhaar, PAN, biometric data, name, photograph), contact information, vehicle information (RC details, registration number, vehicle class), transaction information, technical information (device ID, IP address, geolocation), consent and audit records, and usage information.

7. Vehicle Verification

The Platform and/or Issuing Bank shall conduct backend verification of the Vehicle and ownership details against records available with Government Authorities. If the Vehicle is identified as hotlisted, blacklisted, reported stolen, or otherwise ineligible, the onboarding journey shall be immediately terminated.

8. Wallet

To proceed with FASTag issuance, you are required to load funds into the Wallet linked to your FASTag account. Funds may be loaded through UPI, debit/credit card, net banking, or other payment instruments. No interest shall accrue on the Wallet balance. Amounts successfully credited are non-refundable and shall be utilised solely for toll payments and permitted purposes.

9. FASTag Issuance & Fees

Upon successful completion of KYC verification, vehicle verification, and wallet funding, the Issuing Bank shall proceed to issue a FASTag. Issuance is entirely at the discretion of the Issuing Bank. The Platform may levy a platform/facilitation fee as displayed on the Application. Toll charges are determined by NHAI/IHMCL. All fees are exclusive of applicable taxes.

10. Limitation of Liability

The Services are provided on an "as is" and "as available" basis. The Platform shall not be liable for: rejection or non-issuance of a FASTag by the Issuing Bank; inaccuracies in government databases; outages in UIDAI/NPCI/IHMCL systems; payment gateway failures; or inaccurate information submitted by you. The Platform's aggregate liability shall not exceed the fees actually retained by the Platform for the specific transaction.

11. User Responsibilities

You shall use the Application in compliance with these Terms and applicable law, maintain confidentiality of credentials, ensure accuracy of submitted information, and not attempt to compromise the security of the Application.

12. Fraud

The Platform reserves the right to suspend or terminate your account where it reasonably suspects fraudulent activity, impersonation, or submission of forged documents, and to report such activity to relevant authorities.

13. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. The courts at New Delhi shall have exclusive jurisdiction over any dispute arising out of these Terms.
